Time Warner and AT&T are trying to get the 30% ownership cap overturned any which way they can, and Time Warner is attempting to bring the fight to the U.S.Supreme Court. Time Warner Entertainment has filed a brief requesting the high court to review not only the ownership cap, but the limits the Federal Communications Commission has put on the number of vertically integrated channels cable MSOs can carry.
Under FCC rules, one cable company can only serve 30% of the total number of multichannel video subscribers in the country. Cable operators are also barred from carrying affiliated channels in more than 40% of its first 75 channels.
Time Warner wants the Supreme Court to review the laws on the grounds that they violate the First Amendment.
